New Year Rings in New OSHA Regulations – Part 2

Exempt or Partially Exempt?

There are 2 classes of employers that are exempt from the federal OSHA requirement to keep any of the recordkeeping forms mentioned in Part 1 of New Year Rings in New OSHA Regulations:

  1. Employers with fewer than 11 employees are exempt from recordkeeping requirements, no matter in what industry the employer happens to be engaged.
  1. Employers in certain industries that OSHA has deemed to be low-injury industries are also exempt from recordkeeping requirements, no matter how many employees the employer has.  Such industries are said to be “partially exempt” industries, because they are exempt from keeping the OSHA recordkeeping forms, but please note that they are not exempt from all other OSHA requirements.

OSHA publishes a list of these partially exempt industries.  Formerly the partially exempt industries were listed by Standard Industrial Classification codes (SIC), but they are now listed by North American Industry Classification System codes (NAICS).  A copy of the updated partially exempt list appears below.

Federal OSHA’s new list of industries that are partially exempt, meaning that they are exempt, in Federal OSHA states, from the requirement to keep either the OSHA 300 series of forms or Sharps Injury Logs. Please note, however, that State Plan OSHA states have their own requirements that may differ from Federal OSHA requirements.
